Civil Liberties & Inquests

Civil liberties relate to the basic human rights given to individuals. In many countries, these rights are enshrined in a constitution. The UK does not have a written constitution, as such, instead relying on specific pieces of legislation and legal precedent. The Human Rights Act 1998 incorporates the majority of the human rights and civil liberties set out in the European Convention on Human Rights.

However, sometimes civil liberties are breached by the very agencies who are supposed to protect them. Examples of this include unlawful arrest and detention, mistreatment of protesters by police at demonstrations, assault by the police, inhumane or degrading treatment and, in the worst cases, torture while in police custody or prison.

Areas our members may be able to help with include:

  • Actions against the police – this can relate to unlawful arrest, assault by police, mistreatment in custody or even being bitten by a police dog;
  • Inquests – particularly in relation to deaths in police cells, prisons, secure units and secure wards;
  • The destruction of DNA and fingerprints on police databases when no charges have been brought against you.
